What is an act of unfair competition?
According to the Paris Convention, any act in the field of industrial or commercial competition that is contrary to honest practices is considered an act of unfair competition. This includes, but is not limited to, the following prohibited acts: (1) any act that creates confusion with the establishment, goods, or industrial or commercial activities of a competitor, regardless of the means used;(2) any false allegations made in the course of trade that discredit the establishment, goods, or industrial or commercial activities of a competitor; and (3) any use of indications or allegations in the course of trade that are likely to mislead the public about the nature, manufacturing process, characteristics, suitability for their purpose, or quantity of the goods.
